The Trump administration has launched its first major investigation into alleged fraud involving the H-1B visa programme, widening its efforts to crack down on immigration-related abuse and employment violations.
The investigation will examine allegations linked to H-1B and PERM visa fraud, labour trafficking and the alleged displacement of American workers. The announcement was made by Labour Department Inspector General Anthony D’Esposito as the administration steps up immigration enforcement.
Investigation to Examine Visa Fraud and Labour Abuse
The inquiry is expected to focus on whether the H-1B and PERM visa systems have been misused by employers or organised networks. Officials will also investigate claims of labour trafficking and practices that may have affected employment opportunities for US workers.
The move comes as the White House increases scrutiny of immigration compliance and employment practices. Vice President JD Vance is expected to outline the administration’s broader anti-fraud strategy during an event in Milwaukee later on Wednesday.
Authorities Have Already Issued Dozens of Subpoenas
According to Anthony D’Esposito, investigators have already taken action by issuing several subpoenas as part of the probe.
Speaking to Fox Business, he said, “This is another example where fraud is fueling violent crime. Much of the visa and the human trafficking that we see when it comes to this foreign labor is tied to cartels, is tied to transnational gangs, and this is the work that we should be doing, not only to make America safe again, but to make America more affordable again.”
D’Esposito added that authorities have already served dozens of subpoenas, indicating that the investigation has moved beyond the initial stage and is now actively gathering evidence.
What Is the H-1B Visa Programme?
The H-1B visa programme allows US employers to hire highly skilled foreign professionals for specialised jobs that require technical or professional expertise. The visa is generally issued for an initial period of three years and can be extended for up to six years.
Technology companies continue to account for the majority of H-1B visa applications, making up an estimated 60 to 70 per cent of new filings in recent years. Apart from the technology industry, the programme is widely used by employers in consulting, engineering, manufacturing, healthcare, medical research and higher education.
According to D’Esposito, California, New York and Illinois remain among the leading states for H-1B visa applications.
Immigration Enforcement Drive Continues
The latest investigation marks a significant step in the Trump administration’s wider campaign to tighten immigration enforcement and examine potential abuse within employment-based visa programmes. Officials say the probe will focus on identifying fraudulent practices while investigating allegations related to labour trafficking and the misuse of foreign worker programmes.
