The Federal High Court in Abuja on Thursday refused to grant an ex parte application seeking to bar Senator Ireti Kingibe from taking part in the activities of the African Democratic Congress (ADC).
Ruling on the application, Justice Peter Lifu held that the plaintiffs—two ward leaders of the ADC in Wuse, Federal Capital Territory—must put the senator on notice to allow her respond to the allegations against her.
He said the court must exercise caution in political matters and ensure justice is served by giving all parties the opportunity to present their arguments.
The plaintiffs, Okezuo Anayo and Isaiah Samuel, who are reportedly loyal to the FCT Minister, Nyesom Wike, had asked the court to restrain Kingibe from describing herself as a party member or participating in party activities.
They claimed the senator was suspended on March 10, 2026, for alleged anti-party activities, gross misconduct and violation of the party’s constitution.
In their suit, marked FHC/ABJ/CV/539/2026, they alleged that Kingibe continued to hold parallel meetings, issue statements on behalf of the party and intimidate ward officials using her security aides, despite being informed of her suspension.
They sought interim orders stopping her from attending party meetings, carrying out roles reserved for members, representing the party in any capacity, or interfering in the administration of the Wuse Ward, including access to its register and records.
Justice Lifu, however, ruled that the senator must be served all court processes to enable her prepare her defence.
He adjourned the case to April 20, 2026, for hearing of all pending applications.
Meanwhile, a lawyer, Abubakar Marshall, announced appearance for Kingibe and informed the court that he had filed a preliminary objection challenging the competence of the suit.
He said the objection had been served on the plaintiffs’ counsel, M. S. Garba.
