The Supreme Court on Thursday dismissed another appeal by a faction of the Peoples Democratic Party (PDP) under the leadership of Taminu Turaki.
According to the apex court, a party in contempt of a court order can not approach another court.
The decision was taken on the appeal by the Turaki faction seeking the Supreme Court’s ruling to validate its November 2025 National Convention held in Ibadan, Oyo State.
“A party in contempt of a court order does not have the right to approach another court.”
“Appeal is hereby dismissed,” the court ruled.
The second appeal was dismissed in a split decision of the Supreme Court judges, 3-2.
PrimeTimes Nigeria recalls that the Supreme Court had earlier nullified the national convention of the Peoples Democratic Party (PDP) held in Ibadan, Oyo State, on November 15 and 16, 2025.
It was the convention that had produced a factional national executive of the party led by Tanimu Turaki.
In a split decision delivered on Thursday, three out of five justices of the apex court held that the appeal filed by the Tanimu Turaki-led faction of the PDP lacks merit.
Justice Stephen Adah, who read the majority decision, held that the national convention held in Ibadan, Oyo State, on November 15 and 16, last year, was in defiance of an existing judgment of the Federal High Court, delivered by Justice James Omotosho.
The apex court berated the Turaki-led group for going on to another court of coordinate jurisdiction to secure an order, instead of going on appeal.
It described the move as an abuse of court process.
The apex court’s decision has now affirmed earlier judgments which held that the exercise was conducted in violation of subsisting court orders.
The Ibadan convention had been the subject of prolonged legal disputes before the Supreme Court’s verdict.
